BSWC are carrying out research looking at how the deplatforming and digital exclusion of Sex Workers—especially those who are Black, migrant, trans, and disabled—constitutes a violation of fundamental rights under Article 14 (prohibition of discrimination), in conjunction with Articles 8 and 10 of the European Convention on Human Rights (ECHR), and what legal pathways exist to challenge this form of systemic, digitally mediated discrimination.
BSWC plan to document traceable incidents of deplatforming, surveillance, and digital erasure that demonstrate a pattern of racialised, gendered, and profession-based discrimination. They will generate a legal memorandum assessing jurisdiction, admissibility, and strengths of a potential European Court of Human Rights case, as well as a litigation roadmap developed in collaboration with legal partners and digital rights experts.
